Terms and Conditions


Contract Formation

  1. 1.1 When you submit your order, you are offering to buy tickets at the price stated in accordance with the terms and conditions which, if accepted by us, will result in a binding contract. It is therefore important that you read and accept the terms and conditions before submitting the order.
  2. 1.2 Once you have completed your order, you will be asked to confirm that it is correct. If it is not, you can amend or cancel the order before submitting it. It is your responsibility to ensure it is correct before submission. You should note that payment will be taken when you click the "make payment" button. This does not indicate our acceptance of your offer, and will be refunded in the unlikely event that we refuse the offer.
  3. 1.3 We will send a confirmation email on receipt of your order. This is not an acceptance of your offer, but an acknowledgement that we have received the order, and that our Ticket Office are processing it. The contract between us will not be formed until we dispatch the tickets to the address as stated in your order.
  4. 1.4 Whilst we try to ensure that pricing and ticketing information on our website is correct at all times, errors may occasionally occur. If we discover an error in the price or nature of the ticket you have ordered, we will inform you as soon as possible, and give you the option of reconfirming your order at the correct price/specification or cancelling it. If we are unable to contact you, we will unfortunately have to treat the order as cancelled. If the order is cancelled, we will of course provide you with a full refund.
  5. 1.5 Season Ticket purchases made with a credit card will incur a processing fee of 1.75% of the total value of Season Tickets. No surcharge will be applied on debit card payments.
  6. 1.6 Concession and Junior tickets holders must bring photographic ID on matchday (limited to passport, photographic driving licence, freedom pass and EEC National Identity Card) to verify eligibility. Under 12s must be accompanied by an adult, 18 years and over.


SEASON TICKET CONDITIONS OF ISSUE


Issue of Season Ticket

  1. 1.1The issue of a Season Ticket and subsequent access to the Ground is subject to the Terms & Conditions of Entry.
  2. 1.2Season Tickets are for the use of supporters of the Club only. By applying for a Season Ticket and/or using the same you hereby warrant and represent that you are a supporter of the Club.

Admission to the Ground

  1. 2.1Use of a Season Ticket constitutes acceptance of the Terms & Conditions of Entry.
  2. 2.2A Season Ticket permits you to occupy at the Match the seat indicated on the Season Ticket or such other alternative seat of equal price as the Club may, from time to time, allocate to you at its reasonable discretion.
  3. 2.3Nothing in these Conditions of Issue shall constitute or imply any entitlement to occupy the seat indicated on the Season Ticket in any subsequent season.
  4. 2.4Save as set out in clause 2.5 below, you shall not bring into (or use within) the Ground any equipment which is capable of recording or transmitting (by digital or other means) any audio, visual or audio-visual material or any information or data in relation to a Match or any aspect of it. Any person acting in breach of this provision will be required to deliver up any tapes, films, disks or other recordings or data to the Premier League and/or the Club and the copyright in any such recording or transmission is herby assigned (by way of present assignment of future copyright pursuant to section 91 of the Copyright, Designs, and Patents Act 1988) to the Premier League
  5. 2.5Mobile telephones are permitted within the Ground, provided that they are used for personal and private use only.
  6. 2.6Save for official Club merchandise and/or other football related clothing worn in good faith, you shall not bring into, use or display within the Ground any sponsorship, promotional or marketing materials.
  7. 2.7You shall not offer or distribute (either free or for sale by any person) within the Ground any consumer article or commercial product of any nature. For the avoidance of doubt this clause shall not prevent the lawful distribution of text publications in any format which do not infringe clause 2.6 where both the content and the publication are lawful in all respects and do not in the Club's reasonable opinion constitute a threat to public order.
  8. 2.8The Club reserves the right to refuse admission to, or eject from, the Ground any person who fails to comply with the Terms & Conditions of Entry.

Use of Season Ticket

  1. 3.1 Season Tickets are issued for your sole use and you shall not resell, assign or (save as set out in clause 3.2 below) transfer or lend the Season Ticket or the benefit of it to any other person without the prior written consent of the Club. The reference to reselling the Season Ticket includes reference to offering to sell a Season Ticket, exposing a Season Ticket for sale, making a Season Ticket available for sale by another and advertising that a Season Ticket is available for purchase. For the avoidance of doubt (and by way of example only) this Season Ticket may not be offered as a prize in any promotion or competition nor transferred, lent or sold to any third party as part of a hospitality or travel package, given to a third party who agrees to buy another good or service, or used for any other commercial purpose, save as expressly authorised by the PL or the Club.
  2. 3.2 You may only resell or transfer the Season Ticket to a Guest with the express written consent of the Club given at the Club's absolute discretion. No such resale or transfer will be permitted except where the same takes place in respect of an individual match and in consideration of no payment or benefit in excess of the face value of a ticket to that Match and such transfer does not take place during the course of any business or for the purpose of facilitating any third party's business. Such resale or transfer to any Guest is hereby provided be subject to the Terms and Conditions of Entry which will (save for any rights to transfer under this clause) apply to that Guest as if he/she was the original purchaser of the Season Ticket (and you must inform the Guest of this).
  3. 3.3 The unauthorised sale or disposal of tickets is a criminal offence under section 166 of the Criminal Justice and Public Order Act 1994, as amended by the Violent Crime Reduction Act 2006. The Club will inform the police when it becomes aware that Season Tickets are being sold illegally and will press charges to be brought against those breaking this law. If you are convicted of a ticket touting offence, or we reasonably suspect you have committed a ticketing offence, we will notify the Premier League who may in turn notify other Premier League Clubs and/or the UK Football Policing Unit. The information that we share may include your personal details, information about the offence and about ticket purchases (including payment details). We will use this to identify and prevent ticketing offences and disorder at matches.
  4. 3.4 The Season Ticket will remain the property of the Club at all times and must be produced together with evidence of your identity if required to do so by any official, steward or employee of the Club or any police officer. The Club reserves the right to require the immediate return of the Season Ticket at any time.
  5. 3.5 Any Season Ticket obtained or used in breach of the Terms & Conditions of Entry shall be automatically void and all rights conferred or evidenced by such Season Ticket shall be nullified. Misuse of this Season Ticket may result in the holder being refused entry to, or ejected from, the Ground in respect of a particular Match and/or the cancellation and withdrawal of this Season Ticket. In the event of any cancellation and withdrawal in accordance with this clause 3.5, no refund shall be payable to the holder in respect of any unexpired portion of the Season Ticket. The Club further reserves its right to take any legal action against any person(s) as it sees fit in connection with such matters, including a claim for an account of profits made from an unauthorized use of the Season Ticket.

Changes to Dates, Refunds & Exchanges

  1. 4.1 No guarantees can be given by the Club that a Match will take place at a particular time or on a particular date. The Club reserves the right to reschedule any Match without notice and without any liability whatsoever. Your Season Ticket will enable you to attend the re-arranged Match.
  2. 4.2 The Club will have no further liability whatsoever, including (but not limited to) any indirect or consequential loss or damage, loss of enjoyment or travel costs.

Lost or Stolen Season Tickets

  1. 5.1 In order to gain admission to the Ground the Season Ticket must be presented in its entirety at every Match. If applicable, the numbered vouchers must be torn from Season Ticket books in the presence of the turnstile operator/attendant.
  2. 5.2 In the event that you forget your Season Ticket in respect of any individual Match, the Club shall not be obliged to admit you or issue any other form of ticket for that Match. If a match-day duplicate ticket is issued, the Club may require payment of a non-refundable administration charge.
  3. 5.3 If, in the Club's opinion, a Season Ticket is damaged, lost, stolen or destroyed, a duplicate Season Ticket shall be issued by the Club as soon as reasonably practicable after the payment of a non-refundable administration charge. Only one duplicate Season Ticket will be issued to you per season and you will be required to sign a document confirming that the original Season Ticket is damaged, lost, stolen or destroyed and indemnifying the Club against any direct or indirect consequences of such matter having been falsely represented or stated to the Club.
  4. 5.4 Should any Season Ticket when applied for not arrive in the post after purchase, you will be required to sign a document confirming this and undertaking to immediately return the original Season Ticket to the Club should it come into your possession at any time. There will be no charge for the issue of a duplicate Season Ticket in this instance.

Change of Address

If you change your address during the season you must notify the Club as soon as reasonably practicable.


Cancellation & Withdrawal of Season Ticket

  1. 7.1Without prejudice to any other remedies it may have, the Club shall have the right in the case of any serious or persistent breach of the Terms & Conditions of Entry to cancel and withdraw your Season Ticket. In the event of such cancellation no refund will be paid in respect of any unexpired portion of the Season Ticket. Without prejudice to the general nature of the above the following actions shall constitute serious breach of the Terms & Conditions of Entry:
    1. 7.1.1 smoking in designated non-smoking areas;
    2. 7.1.2 persistent standing in seated areas whilst the Match is in progress;
    3. 7.1.3 sale or transfer (save as permitted) of this Season Ticket to any person;
    4. 7.1.4 deliberate misuse of the Season Ticket;
    5. 7.1.5 the supply of any misleading or incorrect information in any application;
    6. 7.1.6 persistent swearing during the Match;
    7. 7.1.7 the throwing of any object within the Ground without lawful authority or excuse;
    8. 7.1.8 the chanting of anything of an indecent or racist nature;
    9. 7.1.9 any misrepresentation in relation to clause 1.2;
    10. 7.1.10 breach of the terms of any Membership;
    11. 7.1.11 any failure to pay or default of payment in respect of any sums owing to the Club (or any third party) in respect of this Season Ticket.
  2. 7.2In the event that your Season Ticket is withdrawn or cancelled the Club reserves the right to exclude you from any membership scheme maintained or organised by the Club and/or to disqualify you from applying for any Match ticket or season ticket at its discretion.

Exclusion of Liability

To the maximum extent permitted by law, the Club hereby excludes any liability for loss, injury or damage to persons/property in or around the Ground.


Governing Law

These Conditions of Issue shall be governed by and construed in accordance with the laws of England and Wales. The parties hereby submit to the exclusive jurisdiction of the Courts of England and Wales.


Definitions

In the Conditions of Issue the following words and phrases shall have the following meanings:

  • "Conditions of Issue" means these terms and conditions governing the issue and use of a Season Ticket.
  • "Ground" means the football Ground and all other locations owned, occupied or utilised by the Club.
  • "Ground Regulations" means those ground regulations issued by the Club from time to time that set out the terms and conditions upon which spectators are granted entry to the Ground (copies of which are enclosed).
  • "Guest" means a relative, friend, colleague and/or companion to the disabled who would be entitled to purchase a Season Ticket under the Terms and Conditions of Entry.
  • "Match" means any Premier League football match in which the Club participates and that takes place at the Ground during Season 2013-2014.
  • "Season Ticket" means a season ticket booklet (and all or any component vouchers therein) or any season ticket smartcard (and/or any rights arising out of or in connection with any of the foregoing) for admission to Matches.
  • "Terms & Conditions of Entry" means each of the rules and regulations of FIFA, UEFA, The Football Association, The Football Association Premier League Limited and The Football League; the Ground Regulations; and the Conditions of Issue (all of which are available from the Club on request).

MEMBERSHIP CONDITIONS OF ISSUE

  1. 1. Fulham membership cards are not transferable. A membership card is only valid when used by the person to whom it is registered. Any breach of this term will entitle the club to demand the surrender and cancellation of the membership card with no refund issued.
  2. 2. The membership card remains the property of Fulham FC. Membership cards may not be sold, exploited for commercial use, or used for promotional purposes or campaigns without the express written permission of the club.
  3. 3. All Fulham membership schemes are seasonal. The respective fee for each membership is therefore valid for one season only. Memberships purchased for use during season 13/14 shall expire on 31 May 2014.
  4. 4. The membership fee is for one season. The fee will not be reduced for new applicants wishing to join at any point once the season is underway.
  5. 5. The club cannot accept any responsibility for membership cards that are lost or destroyed. Lost membership cards should be reported immediately to the Membership Department on 0843 208 1234 (option 2). Replacements will only be issued in special circumstances and at a cost of £5.
  6. 6. All members must comply with Fulham FC Ground Regulations and match ticket terms and conditions. Any violation of these may result in membership being withdrawn or cancelled.
  7. 7. All Adult membership applicants based in the UK must be on the electoral register and living at the address given on application. Fulham FC reserves the right to refuse an application if the name of the applicant is not registered at their stated address. The club also reserves the right to cancel without refund any memberships that are discovered to be registered to addresses that are not the primary residence of the card holder.
  8. 8. In the event of a cup-tie, members joining once the draw has taken place will not be eligible to obtain ticket priority for that fixture.
  9. 9. Fulham membership gives ticket priority at the same time as Season Ticket Holders for home games in the Barclays Premier League and after Season Ticket Holders for away games, unless Loyalty Points are used as a means of determining eligibility.
  10. 10. The number of tickets available to purchase by individual members may vary on a match to match basis. It is the responsibility of the member to find out when tickets go on sale for each game, when the members' priority booking period commences and how many tickets they are able to purchase for that game. The club will do its utmost to ensure that every available club communication channel is utilised to provide ticketing information.
  11. 11. A maximum of 4 membership cards may be used in one transaction (i.e. no more than 4 cards can be presented in one application).
  12. 12. Fulham membership does not guarantee a ticket to each game. It is recommended that you book your ticket at your earliest convenience to maximise your chances of success.
  13. 13. All rights to priority regarding ticket sales for away games are at the discretion of the Club and membership does not guarantee tickets for any specific game.
  14. 14. If Fulham FC suspects for any reason that the card is being used fraudulently to obtain matchday tickets, then the club retains the right to ban the offending individual(s) from the Club.
  15. 15. Ticket priority for Junior Members extends only to applications for Junior tickets. Junior Memberships may be linked to Adult Memberships by ‘Friends & Family’ to consolidate a ticketing allowance.
  16. 16.No refunds will be given in respect of membership fees.
  17. 17. If you are convicted of a ticketing offence, or we suspect you have committed a ticketing offence, we will notify the FA Premier League who in turn may notify the UK Football Policing Unit. The information that we share may include your details, information about the offence and about ticket purchases. We will use this to identify and prevent ticketing offence and disorder at matches.   18. 18. Memberships will be processed within 10 working days.
  19. 19. The club reserves the right to amend these terms and conditions at any time.


HOME MATCH TICKET CONDITIONS OF ISSUE


Issue of Home Match Ticket

  1. 1.1The issue of a Home Match Ticket and subsequent access to the Ground is subject to the Terms & Conditions of Entry.
  2. 1.2Home Match Tickets are for the use of supporters of the Club only. By applying for the Home Match Ticket and/or using the same you hereby warrant and represent that you are a supporter of the Club.

  1. 2.1Use of the Home Match Ticket constitutes acceptance of the Terms & Conditions of Entry.

The reference to reselling the Home Match Ticket includes reference to offering to sell a Home Match Ticket, exposing a Home Match Ticket for sale, making a Home Match Ticket available for sale by another and advertising that a Home Match Ticket is available for purchase. For the avoidance of doubt (and by way of example only) this Home Match Ticket may not be offered as a prize in any promotion or competition or transferred, lent or sold to any third party as part of a hospitality or travel package, given to a third party who agrees to buy another good or service or used for any other commercial purpose save as expressly authorised by the PL or the Club.

  3. 3.3 If more than one Home Match Ticket is issued to you one Home Match Ticket must be retained by you for personal use (subject to the provisions below) and the remainder may be transferred to your Guest(s) for his/her personal use only PROVIDED THAT such transfer takes place in consideration of no payment or benefit in excess of the face value of the Home Match Ticket, and such transfer does not take place in the course of any business or for the purpose of facilitating any third party's business. Such transfer to any Guest will be subject to the Terms & Conditions of Entry which will (save for any rights to transfer under this clause or any rights to a refund under clause 4.3) apply to the Guest as if he were the original purchaser of the Home Match Ticket (and you must inform the Guest of this). You will provide the name and address of your Guest(s) when asked to do so by any official, steward or employee of the Club or any police officer. In the event that you and/or your Guest are unable to use any Home Match Ticket then you may transfer that Home Match Ticket(s) to a natural person who is known to you personally who would be entitled (under the Terms & Conditions of Entry) to purchase such Home Match Ticket and attend such Match PROVIDED THAT such transfer takes place in consideration of no payment or benefit in excess of the face value of the Home Match Ticket, and such transfer does not take place in the course of any business or for the purpose of facilitating any third party's business. Such transfer will be subject to the Terms & Conditions of Entry which will (save for any rights to transfer under this clause or any rights to a refund under clause 4.3) apply to the transferee as if he were the original purchaser of the Home Match Ticket (and you must inform the transferee of this). You will provide the name and address of the transferee when asked to do so by any official, steward or employee of the Club or any police officer.
  4. 3.4 The Home Match Ticket will remain the property of the Club at all times and must be produced together with evidence of your identity if required to do so by any official, steward or employee of the Club or any police officer. The Club reserves the right to require the immediate return of the Home Match Ticket at any time.
  5. 3.5 Any Home Match Ticket obtained or used in breach of the Terms & Conditions of Entry shall be automatically void and all rights conferred or evidenced by such Home Match Ticket shall be nullified. Misuse of this Home Match Ticket may result in the holder being refused entry to, or ejected from, the Ground in respect of a particular Match and/or the cancellation and withdrawal of this Home Match Ticket. In the event of any cancellation and withdrawal in accordance with this clause 3.5, no refund shall be payable. The Club further reserves its right to take any legal action against any persons as it sees fit in connection with such matters, including a claim for an account of profits made from an unauthorized use of the Home Match Ticket.

Changes to Dates, Refunds & Exchanges

  1. 4.1 No guarantees can be given by the Club that the Match will take place at a particular time or on a particular date. The Club reserves the right to reschedule any Match without notice and without any liability whatsoever, other than that detailed in Clause 4.2.
  2. 4.2 In the event of the postponement or abandonment of the Match, you will be entitled to receive a full refund (including any booking fee) or receive the equivalent ticket for the subsequent re-arranged Match via such application procedure as the Club stipulates. The Club will have no further liability whatsoever, including (but not limited to) any indirect or consequential loss or damage, loss of enjoyment or travel costs.
  3. 4.3 In order to obtain a refund, the Home Match Ticket must be returned to the Club's ticket office within 7 days of the rescheduling announcement (which shall be made on fulhamfc.com) provided this is still more than 7 days before the rescheduled date. Tickets that include hospitality are subject to their own terms and conditions. It is the responsibility of the ticket holder to check the date and kick off time of matches. A refund will only be issued on production of identification that the individual requesting the refund is the person to whom the Home Match Ticket was originally sold. For the avoidance of doubt, the final decision belongs to the Ticket Office Manager.

Lost or Stolen Home Match Tickets

  1. 5.1 In order to gain admission to the Ground the Home Match Ticket must be presented in its entirety at the Match.
  2. 5.2 The Club shall not be obliged to issue any replacement for a lost, stolen or destroyed Home Match Ticket.

Cancellation & Withdrawal of Home Match Ticket

  1. 6.1 Without prejudice to any other remedies it may have, the Club shall have the right in the case of any serious or persistent breach of the Terms & Conditions of Entry to cancel and withdraw any Home Match Ticket issued to you. In the event of such cancellation no refund will be paid. Without prejudice to the general nature of the above the following actions shall constitute serious breach of the Terms & Conditions of Entry:
    1. 6.1.1 smoking in designated non-smoking areas;

    10. 6.1.10 any failure to pay or default of payment in respect of any sums owing to the Club (or any third party) in respect of a Home Match Ticket.
  2. 6.2 In the event that your Home Match Ticket is withdrawn or cancelled the Club reserves the right to exclude you from any membership scheme maintained or organised by the Club and/or to disqualify you from applying for any Match ticket or season ticket at its discretion.

Exclusion of Liability

  • "Match" means any Premier League football match in which the Club participates and that takes place at the Ground during Season 2012-2013.
  • "Home Match Ticket" means a printed paper ticket or other form of ticket (and/or any rights arising out of or in connection with the foregoing) for admission to a Match.
  • "Terms & Conditions of Entry" means each of the rules and regulations of FIFA, UEFA, The Football Association, The Premier League ("PL"), and The Football League; the Ground Regulations; and the Conditions of Issue.

HOSPITALITY PURCHASE TERMS & CONDITIONS


1. Definitions

In these General and Special Terms and Conditions (as applicable) (the "Conditions") the following words shall have the following meanings:


  • "Booking Confirmation" means the booking confirmation form issued by Fulham, returned and signed by you.
  • "Equipment" means any equipment provided by Fulham in the course of the Services as set out in the Booking Confirmation.
  • "Event/Hire/Service Date(s)" means the date(s) on which the Services are to be provided as set out in the Booking Confirmation.
  • "Fee" means the amount to be paid by you as set out in the Booking Confirmation in respect of the Services.
  • "Fulham" means Fulham Football Club (1987) Limited whose registered office is at Motspur Park, New Malden, Surrey KT3 6PT.
  • "Guest(s)" means the limited number of person(s) that you are authorised to invite to attend the Licensed Area in the course of the provision of the Services.
  • "Licensed Area" means any area(s) in the Stadium or at the Training Ground (as applicable) licensed to you for use in the course of the Services on the Event/Hire Dates as set out in the Booking Confirmation.
  • "Services" means the agreed services to be provided in accordance with these Conditions by or on behalf of Fulham as set out in the Booking Confirmation.
  • "Stadium" means the pitch, grounds, stadium and related facilities (including, without limitation, the Licensed Area) and any part thereof at Craven Cottage, Stevenage Road, Fulham, London SW6 6HH.
  • "Training Ground" means the pitches, grounds and related facilities (including, without limitation, the Licensed Area) and any part thereof at Motspur Park, New Malden, Surrey, KT3 6PT.
  • "you" / "your" means the person, firm, organisation or company as stated in the Booking Confirmation.

2. Application of the Conditions

These Conditions alone shall govern the provision of the Services to you by or on behalf of Fulham. No other terms or conditions whether contained or referred to in any documentation, correspondence, purchase order or elsewhere sent by you or otherwise implied by trade, custom or course of dealing shall apply unless specifically agreed in writing by Fulham.


3. Payment

  1. 3.1 Unless otherwise agreed in writing, you shall pay (without retention or set-off) the full Fee and any additional amounts required in accordance with the Booking Confirmation within 14 days of date of invoice and/or the applicable special conditions (set out below) that apply to the particular Services, together with any VAT due thereon. If the Event/Hire/Service date is within 14 days of the booking, you shall pay (without retention or set-off) the full Fee and any additional amounts required in accordance with the Booking Confirmation, together with any VAT due thereon, at the time of the booking. No payment shall be deemed received until Fulham has received cleared funds. Time for payment shall be of the essence.
  2. 3.2 If we do not receive a signed Booking Confirmation and payment in full of the Fee at least 14 days before the Event/Hire/Service Date we reserve the right to cancel the Services ordered by you.
  3. 3.3 Fulham reserves the right to resell the Services (or any part thereof) in the event of any default in payment, postponement or cancellation.
  4. 3.4 Where any sums are outstanding, Fulham reserves the right to refuse to supply the Services and/or to cancel or suspend all existing arrangements without prejudice to any of its other rights, whether or not contained in these Conditions. In addition, Fulham shall be entitled to claim interest and compensation for debt recovery costs under all applicable United Kingdom late payment legislation; and any charges and legal and other costs that we incur in pursuing or enforcing any legal or debt recovery action, if we are not paid according to agreed credit terms.

4. Cancellations and Rearrangement of Services

  1. 4.1 Event/Hire Dates (including, without limitation, football match fixture dates) may be subject to change from time to time for reasons beyond Fulham's control (including, without limitation, television scheduling, cup competitions and postponement due to adverse weather conditions). In the event that there is a change to the Event/Hire Date(s) or the nature of the Services, Fulham shall notify you of such change, postponement or cancellation as soon as reasonably practicable by telephone. If you do not wish to continue with the booking on any rescheduled date offered to you by Fulham (if such rescheduling is possible), you must advise Fulham immediately and in such circumstances, any Fee received from you in respect of the cancelled part of the Services will be refunded.
  2. 4.2 If you cancel your booking for any reason, Fulham shall be entitled to charge you the cancellation fees set out below. If Fulham receives notice of cancellation:
  3. (a) less than 14 days prior to the Event/Hire/Service Date(s), Fulham shall be entitled to the full Fee;
  4. (b) between 14 and 21 days prior to the Event/Hire/Service Date(s), Fulham shall be entitled to 50% of the Fee; or
  5. (c) more than 21 days prior to the Event/Hire/Service Date(s), Fulham shall be entitled to 25% of the Fee.

5. Guests

  1. 5.1 You warrant and undertake that you and any Guests shall:

6. Warranties

  1. 6.1 You shall be responsible and liable for the conduct of all Guests and shall ensure that all Guests conduct themselves in an orderly fashion, refrain from anti-social behaviour and abide by these Conditions and all applicable dress-codes and ground regulations. Failure to do so may result in Fulham cancelling the Services at any time without liability or refund to you.
  2. (a) only use the Licensed Area for the purposes of the Services during the Event/Hire Date(s);
  3. (b) not use the Licensed Area for any purpose which Fulham may consider (in its sole discretion) illegal, immoral or dangerous;
  4. (c) not cause any nuisance or annoyance to any other person whatsoever, nor cause any obstruction to the access or egress at the Stadium, Training Ground (as applicable) and/or the Licensed Area;
  5. (d) not damage the Licensed Area, Stadium and/or Training Ground (as applicable), nor litter or leave waste, but keep it in a clean and tidy condition, at all times to Fulham's satisfaction;
  6. (e) not bring into the Licensed Area, Stadium and/or Training Ground (as applicable) any dangerous or illegal substances;
  7. (f) not install or tamper with any fixtures or fittings in the Licensed Area, Stadium and/or Training Ground (as applicable);
  8. (g) ensure that the Equipment is at all times used in a skilful and proper manner and in accordance with any instructions given to you by Fulham;
  9. (h) not alter or damage nor attempt to repair or otherwise tamper with the Equipment or request that a third party do so without Fulham's prior written consent;
  10. (i) at all times comply with the instructions of Fulham and/or its officers, employees or agents;
  11. (j) at all times comply with any dress-codes, ticketing conditions and ground regulations; and
  12. (k) more than 21 days prior to the Event/Hire/Service Date(s), Fulham shall be entitled to 25% of the Fee.

7. Equipment

  1. 7.1 Unless otherwise agreed in writing by Fulham, you shall only be permitted to use Fulham's Equipment during the course of the Services where equipment of that nature is required.
  2. 7.2 Unless otherwise agreed in writing by Fulham, the Fee shall include the cost of hiring and using the Equipment on the Event/Hire Dates specified on the Booking Confirmation.
  3. 7.3 The Equipment is and shall remain at all times the property of Fulham or its relevant third party supplier and you shall have no right, title or interest to the Equipment.
  4. 7.4 It is your responsibility to ensure that the Equipment requested is suitable and adequate in all aspects for the purpose for which it is hired.

8. Liability

  1. 8.1 Nothing in these Conditions shall limit either party's liability for death or personal injury caused by its negligence, or for fraudulent misrepresentation.
  2. 8.2 To the fullest extent permissible in law, neither Fulham nor any of its officers, employees or agents shall be liable or responsible for (whether in tort, contract or otherwise):
  3. (a) any loss, damage or injury to you and/or any Guest or to any property belonging to you or any Guest in or upon the Stadium, Training Ground and/or the Licensed Area, resulting from any cause whatsoever; and/or
  4. (b) for any loss of profit, loss of use, loss of opportunity or any indirect, economic or consequential losses whatsoever; and/or
  5. (c) any cancellation, postponement or rearrangement of the Services in accordance with clause 4.1 by Fulham (save to make any refund in accordance therewith).
  6. 8.3 You shall indemnify and hold Fulham and its officers, employees and agents harmless in respect of:
  7. (a) any breach by you and/or your Guests of any of your warranties, undertakings and/or obligations under these Conditions; and/or
  8. (b) any damage caused by you and/or your Guest(s) to the Licensed Area, Stadium, Training Ground and/or the Equipment.

9. Termination

  1. 9.1 This Agreement may be terminated immediately upon written notice by Fulham without liability if:
  2. (a) there is any default in payment of the Fee in accordance with these Conditions;
  3. (b) you fail to observe or perform any of your warranties, undertakings and/or obligations under these Conditions;
  4. (c) you are unable to pay your debts as and when they fall due, an order is made or resolution passed for you to be declared bankrupt or be wound up (as appropriate), or if an administrator, receiver or manager or administrative receiver shall be appointed over the whole or any part of your undertakings or assets.

10. Force Majeure

Fulham shall not be deemed to be in breach of these Conditions or otherwise liable to you as a result of any delay or failure in the performance of its obligations under these Conditions if and to the extent that such a delay or failure is caused by Force Majeure. "Force Majeure" means any circumstances outside the reasonable control of Fulham including, without limitation, acts or threatened acts of terrorism, strikes, lockouts, industrial disputes or other restraints or stoppages of labour, acts of God, war, riot, civil commotion, malicious damage, compliance with any law or governmental order rule or direction, rules or instructions of any regulatory body (including (without limitation) The Football League, UEFA and/or The FA Premier League), inability to obtain supplies, inclement weather, accident, breakdown of Equipment, plant or machinery, fire, flood or storm.


11. Miscellaneous

  1. 11.1 No food or alcohol may be brought into the Stadium and/or Training Ground (as applicable). Save in the case of corporate hospitality packages, if food or alcohol is required, arrangements should be made with Fulham. Alcohol may not be consumed on or in the vicinity of the pitch and otherwise may only be consumed in areas designated by Fulham.
  2. 11.2 Food orders must be placed at least 7 days prior to the Event/Hire Date(s), with full payment for the food to be made when placing the order. Food orders can be cancelled or reduced up to 7 days before the Event/Hire Date(s), with a full refund. Any amendments made after that time will not be refunded.
  3. 11.3 Smoking is only permitted in designated areas. Fulham and/or its officers, employees or agents shall be entitled to eject any persons reasonably believed to be smoking in non-designated areas at the Stadium and/or Training Ground (as applicable).
  4. 11.4 If match tickets are issued, it is your responsibility to safeguard these. Any tickets lost, destroyed or stolen will not be reissued nor refunds given by Fulham. You shall and shall ensure that all Guests shall comply with these Conditions including all applicable ticketing conditions, dress-codes and ground regulations at all times.
  5. 11.5 Nothing in these Conditions or the Booking Confirmation shall be intended to or deemed to operate as a tenancy or lease in respect of the Licensed Area or otherwise and neither you nor your Guests shall be entitled to any estate, right, title or interest in any part of or all of the Stadium and/or Training Ground (as applicable).
  6. 11.6 Fulham reserves the right, in its sole discretion, to refuse admission to you, any Guests and/or any other individual(s) to the Stadium and/or Training Ground (as applicable) and/or to evict you, any Guests and/or any other individual(s) from such venues.
  7. 11.7 Fulham reserves the right to amend these Conditions at its discretion.
  8. 11.8 Any personal information, including (without limitation), your name, address (including postcode) and/or email address will be held by Fulham in accordance with Fulham's privacy policy, which is available on the Fulham's website at www.fulhamfc.com.
  9. 11.9 No waiver by Fulham of any breach of these Conditions shall be considered as a waiver of any subsequent breach of the same or any other provision.
  10. 11.10 If any provision of these Conditions is held by any competent authority to be invalid or unenforceable in whole or in part the validity of the other provisions of these Conditions and the remainder of the provisions in question shall not be affected thereby.
  11. 11.11 This Agreement is personal to you. You shall not co-license, sub-license, sell, assign, pledge or otherwise transfer your rights under this Agreement, without the prior written consent of Fulham.
  12. 11.12 To the fullest extent permissible in law, neither these Conditions nor the Booking Confirmation are intended to nor shall they create any rights, entitlements, claims or benefits enforceable by any third person (including, without limitation, Guests). Accordingly, no person shall derive any benefit or have any right, entitlement or claim in relation to these Conditions or the Services by virtue of the Contracts (Rights of Third Parties) Act 1999.
  13. 11.13 These Conditions shall be governed and construed in accordance with the Laws of England and Wales. The English Courts shall have exclusive jurisdiction in the event of any dispute other than in relation to the enforcement of judgments, where such jurisdiction shall be non-exclusive.

12. Personal Data

  1. 12.1 You acknowledge that in completing the Booking Confirmation you may provide Fulham with certain personal details about yourself ("Personal Data"). All Personal Data collected by Fulham using the Booking Confirmation or otherwise in connection with booking Services will only be held and used with care and in accordance with Fulham's privacy policy (available at www.fulhamfc.com) and the Data Protection Act 1998.
  2. 12.2 Fulham will use Personal Data for the purpose of providing the Services and to send you information about Fulham, its sponsors, partners and affiliates. In using the Services you consent to such use of your Personal Data unless you expressly opt-out as set out in the Booking Confirmation.

SPECIAL CONDITIONS


Match-day / Non-Match day Corporate Hospitality and conferencing

Unless otherwise stated on the Booking Confirmation, the Fee is due and payable by you to Fulham immediately upon booking. Bookings are not confirmed until receipt of full payment.
The Services and Equipment to be provided shall be strictly as set out on the Booking Confirmation. It is your responsibility to ensure that the Services and Equipment you require are correctly set out on the Booking Confirmation.
Fulham reserves the right to refuse entry to the Licensed Area, Stadium and/or Training Ground (as applicable) should you and/or any Guest fail to provide a valid ticket and/or any other required proof of entry.


Pitch Hire

Unless otherwise stated on the Booking Confirmation, 25% of the Fee must be paid on booking, with the balance to be paid at least 28 days before the Event/Hire Date(s). Bookings are not confirmed until receipt of full payment.
The Services and Equipment to be provided shall be strictly as set out on the Booking Confirmation. It is your responsibility to ensure that the Services and Equipment you require are correctly set out on the Booking Confirmation.
The pitch may only be used for playing football. Match officials can be provided, if requested in advance, at an additional cost.
You must ensure that adequate provision is made for the health and safety of any Guest(s) attending the Stadium and/or Training Ground (as applicable) on the Event/Hire Dates including the provision of First Aid throughout the duration of the Services. If requested, Fulham can provide First Aid on the Event/Hire Dates at an additional cost. "First Aid" means person(s) who hold a current first aid certificate and have undergone a training course in administering first aid and suitable first aid equipment.
You must ensure that you and your Guests wear trainers or football boots at all times when using the pitch and remain within the designated parts of the pitch and/or Stadium or Training Ground (as applicable), as may be notified to you by Fulham.


Advertising (Programme and/or Perimeter Boarding)

Unless otherwise stated on the Booking Confirmation, the Fee is due and payable by you to Fulham in accordance with the Booking Confirmation Form.
The size, location and duration of any advertising will be as set out in the Booking Confirmation or as otherwise agreed by Fulham in writing. However, you agree and acknowledge that Fulham shall have final approval over the display, location and content of any advertising.
You warrant and undertake to Fulham that:

  1. (a) all advertising that you or any third party on your behalf provides is the correct size, font and format, as shall be pre-agreed by Fulham in writing;
  2. (b) all advertising will be supplied to Fulham on or before the date notified by Fulham to you. Failure to do so may result in the delayed or non-appearance of advertising without liability to Fulham;
  3. (c) any and all advertising that you or any third party on your behalf provides to Fulham does not and shall not infringe the rights of any third parties, including copyright and any other intellectual property rights;
  4. (d) you shall have no right to use Fulham's name, trade marks or logos or in any way impute an association with the Stadium, Fulham Football Club, its staff (including (without limitation) its players and coaches) in your advertising or promotions or otherwise in the course of trading without Fulham's prior written consent;
  5. (e) you are the owner of all advertising that you or any third party on your behalf provides to Fulham and you are appropriately licensed in respect of such advertising and in either case you have the necessary rights and consents to allow the advertising to be displayed in accordance with the Booking Confirmation; and
  6. (f) any and all advertising will comply with all applicable laws and regulations and shall not be indecent, offensive or defamatory.
  7. (g) Fulham will not in any way be responsible for the content of your advertising, notwithstanding Fulham's final approval over the same, and you hereby indemnify Fulham from and against any and all liability, damages, costs, expenses (including legal fees), claims and other losses incurred by Fulham arising out of the use or appearance of the advertising.

WEEE REGULATIONS


The Waste Electrical and Electronic Equipment (WEEE) Directive requires countries to maximise separate collection and environmentally friendly processing of WEEE items. In the UK, distributors including retailers must provide a system which allows all customers buying new electrical equipment the opportunity to recycle their old items free of charge. If we do not recycle electrical items they will end up in landfill where hazardous substances will leak out and cause soil and water contamination – harming wildlife and also human health. As a responsible retailer, we have met the requirements placed on us by offering all customers buying new electrical equipment free take-back of their old electricals on a like-for-like basis. Unwanted items should be returned to us by post within 28 days of purchasing your new product. Please do not throw electrical equipment (including those items marked with the crossed out wheeled bin symbol) in your bin, recycle them instead.


GROUND REGULATIONS


Notice: Entry to the Ground is expressly subject to acceptance by the visitor of these Ground Regulations and the rules and regulations of FIFA, UEFA, The Football Association, The Premier League and The Football League in respect of the relevant competition. The Ground Regulations incorporate the Club's Customer Charter (if any). Entry to the Ground shall constitute acceptance of the Ground Regulations.

"Ground" means this football stadium and all locations owned, occupied or utilised by the Club. "Club" means this football club.

"Match" means any association football match taking place at the Ground.

"Material" means any audio, visual or audio-visual material or any information or data.

"Football Authorities" means The Premier League, Football Association, the Football Association of Wales, FIFA, UEFA and any other relevant governing body of association football


  1. 1. Notwithstanding possession of any ticket the Club, any police officer or authorised steward may refuse entry to (or eject from) the Ground any person:
    1. 1.1 that fails (or in the Club's reasonable opinion is likely to fail) to comply with these Ground Regulations or any reasonable instruction issued by a police officer or authorised steward; and/or
    2. 1.2 whose presence within the Ground is, or could (in the Club's reasonable opinion), constitute a source of danger, nuisance or annoyance to any other person.
  2. 2. On no account will admission be granted to a person who is the subject of a current Banning Order under the Football Spectators Act 1989 (as amended) or has been convicted of ticket touting offences under the Criminal Justice and Public Order 1994 (as amended).
  3. 3. The Club excludes to the maximum extent permitted by law any liability for loss, injury or damage to persons/property in or around the Ground.
  4. 4. No guarantees can be given by the Club that a Match will take place at a particular time or on a particular date and the Club reserves the right to reschedule the Match without notice and without any liability whatsoever.
  5. 5. In the event of the postponement or abandonment of the Match, refunds (if any) will be made in accordance with the Club's Customer Charter. The Club will have no further liability whatsoever, including (but not limited to) any indirect or consequential loss or damage, such as (but not limited to) loss of enjoyment or travel costs.
  6. 6. All persons seeking entrance to the Ground acknowledge the Club's right to search any person entering the Ground and to refuse entry to or eject from the Ground any person refusing to submit to such a search.
  7. 7. The following articles must not be brought within the Ground - knives, fireworks, smoke canisters, air-horns, flares, weapons, dangerous or hazardous items, laser devices, bottles, glass vessels, cans, poles and any article that might be used as a weapon and/or compromise public safety. Any person in possession of such items will be refused entry to the Ground.
  8. 8. Further, you may not bring into the Ground any sponsorship, promotional or marketing materials save in respect of official club merchandise and/or other football related clothing worn in good faith nor may you offer (either free or for sale by any person) any goods (including literature) of any nature without the express written approval of the Management.
  9. 9. The use of threatening behaviour, foul or abusive language is strictly forbidden and will result in arrest and/or ejection from the Ground. The Club may impose a ban for one or more Matches.
  10. 10. Racial, homophobic or discriminatory abuse, chanting or harassment is strictly forbidden and will result in arrest and/or ejection from the Ground. The Club may impose a ban for one or more Matches.
  11. 11. The following acts are offences under the Football (Offences) Act 1991 (as amended):
    1. 11.1 The throwing of any object within the Ground without lawful authority or excuse.
    2. 11.2 The chanting of anything of an indecent or racialist nature.
    3. 11.3 The entry onto the playing area or any adjacent area to which spectators are not generally admitted without lawful authority or excuse.
    Conviction may result in a Banning Order being made.
  12. 12. All persons entering the Ground may only occupy the seat allocated to them by their ticket and must not move from any one part of the Ground to another without the express permission or instruction of any steward, officer of the Club and/or any police officer.
  13. 13. Nobody may stand in any seating area whilst play is in progress. Persistent standing in seated areas whilst play is in progress is strictly forbidden and may result in ejection from the Ground.
  14. 14. The obstruction of gangways, access ways, exits and entrances, stairways and like places is strictly forbidden. Nobody entering the Ground shall be permitted to climb any structures within the Ground.
  15. 15. Premier League stadia are smoke-free and smoking is not permitted inside the Ground.
  16. 16. Mobile telephones are permitted within the Ground, provided that they are used for personal and private use only PROVIDED THAT no audio, visual or audio-visual material captured by a mobile telephone may be published or otherwise made available to any third parties including, without limitation, via social networking sites.
  17. 17. Under the Sporting Events (Control of Alcohol etc) Act 1985 (as amended), the following are offences for which a person can be arrested by a police officer and conviction could result in a Banning Order being made:
    1. 17.1 Attempting to enter the Ground or being inside the Ground whilst drunk;
    2. 17.2 Being in possession of any intoxicating liquor, or bottle, can or other portable container and which could cause damage or personal injury, when entering the Ground or in a public area of the Ground from which the event can be directly viewed.
  18. 18. Any individual who has entered any part of the Ground designated for the use of any group of supporters to which he does not belong may be ejected from the Ground either for the purposes of his own safety or for any other reason.
  19. 19. Save as set out in paragraph 16 above, no person (other than a person who holds an appropriate licence) may bring into the Ground or use within the Ground any equipment, which is capable of recording or transmitting (by digital or other means) any audio, visual or audio-visual material or any information or data in relation to the Match or the Ground. Copyright, database rights and any other intellectual property rights in any unauthorised recording or transmission is assigned (by way of present assignment of future rights to the Club and The Premier League. You further agree (if and whenever required to do so by the Club and/or The Premier League) to promptly execute all instruments and do all things necessary to vest the right, title and interest in such rights to the Club and The Premier League absolutely and with full title guarantee.
  20. 20. No goods (including literature) of any nature may be offered either free or for sale by any person within the Ground without the express written permission of the Club.
  21. 21. Tickets are not transferable and may not be offered for sale without the prior written permission of the Club. Any tickets that are transferred are transferred subject to these Ground Regulations. Any tickets offered for sale may be confiscated by any steward, officer of the Club or any police officer. The Club reserves the right to refuse admission to or eject from the Ground, any person who has transferred his/her ticket in contravention of the relevant ticket terms and conditions (and/or the holder of any ticket that has been transferred in contravention of the relevant ticket terms and conditions.) Tickets remain the property of the Club at all times.
  22. 22. CCTV cameras are in use around and in the Ground and the Club may itself use or pass to the police or any Football Authority or other clubs, any recordings for use in any proceedings.
  23. 23. At all times whilst present in the Ground, persons must comply with any and all instructions of any steward or officer of the Club and/or any police officer. Failure to comply with any instruction may lead to immediate ejection from the Ground.
  24. 24. By entering the Ground, all persons are acknowledging that photographic images and/or video recordings (and/or stills taken from video recordings) may be taken of them and may also be used in televised coverage of the game or by the Club or any Football Authority for marketing or promotional purposes. Entry into the Ground is confirmation that all persons have consented to such use of their image. If these images should feature an individual prominently the Club will make reasonable efforts to gain the consent of that person before publishing such images, however, if this is not possible, then entry into the Ground shall be deemed consent unless the Club is notified in writing to the contrary.
  25. 25. Further to paragraph 24, if such person is under 18 years of age, the parent, guardian, or responsible adult who is accompanying them into the Ground shall be deemed to have provided consent on their behalf.
  26. 26. Refused entry to (or ejection from) the Ground may lead to further action by the Club including, but not limited to, the withdrawal of any season ticket (without reimbursement), Club Membership and other benefits.
